This position will oversee the preparation and execution of lender notifications under Provincial legislation requirements. Administering lien registrations and removal for encumbered motorized assets. Additionally, contracts, including non-disclosure, customer, partner, vendor, supplier, and professional services agreements. You will work with trustees, towing and transportation partners, lenders, collateral management partners and bailiffs. This will require the ability to manage multiple matters across various stakeholders. This position will also involve compliance review and research to ensure that our processes appropriately mitigate risk and are inline with applicable compliance requirements Provincially and Federally.
They are looking for legal clerk that enjoys working closely with others on a small team. The company is experiencing rapid growth, and you will have the opportunity to build out processes and procedures to help sustain that growth. While this position will focus on document preparation, you will have the opportunity to take on additional responsibilities as they continue to expand.
Duties include (but are not limited to):
Draft, review, negotiate and advise on a wide variety of legal notices and agreements.
Provide counsel on legal risks across the company’s business areas and advise on contract strategies to mitigate those risks.
Research and stay abreast on applicable regulatory and legal developments specific to:
- The Federal Bankruptcy and Insolvency Act
- Warehouse Liens Act [RSBC 1996] CHAPTER 480
- Personal Property Securities Act Section 50(3)
- The Personal Property Security Act, 1993 subsection 50 & 68
- Garage Keepers, C.C.S.M. c. G10, and Garage Keepers Act, Section 13
- Repair and Storage Liens Act, R.S.O. 1990, chapter R.25
- Storer’s Lien Act 2011, c.225
- Personal Property Security Act of 1995-96 c.13
- Warehouser’s Lien Act (1998) RSNL C W-2- as amended
- Warehousemen’s Lien Act (1974) RSPEI c W-1- as amended
Review the drafted company legal templates and playbooks.
Address other ad-hoc or specialized legal issues as they arise.
Position requirements:
Law Clerk/ Paralegal Degree from an accredited association
Minimum of 5 years of firm or in-house experience.
